Joint Policy Advisory and Technical Advisory Committee Meeting
February 8, 2001
I. Call to Order
The meeting was called to order at 10:05 AM in the District conference room. Committee members present are listed below.

IV. Review and Discuss Draft Versions of Proposed Ordinances
A. Draft Ordinance No. 97 – An Ordinance of the Board of Directors of the Monterey Peninsula Water Management District Amending Water Use Credit Transfer Rules
On a motion by Choates and second by Potter, the committees agreed unanimously to support Section Three, 9 of the ordinance that limits the sale price of water credits to the connection fee that would apply to the increment of water use capacity pursuant to Rule 24.
The following comments were raised during discussion of the ordinance.
1. Suggest that the ordinance require that any unneeded water credits from the originating site be transferred to the jurisdiction’s allocation
2. The jurisdictions could adopt water transfer regulations similar to those approved by the City of Monterey, and there would be no need for the District to adopt this ordinance. Each jurisdiction could adopt rules limiting the sale price of water credits.
3. Objection to “criminalizing” behavior in Section Three, 10A and 10B. The revocation of the transfer credit should be only punishment for violation of the ordinance.
4. Suggest that it is not necessary to specify that the Board will only approve commercial to commercial transfers, since all transfers must be approved by the jurisdiction before the District can transfer the water.
5. Clarify transfer process in ordinance. It should state that in addition to commercial to commercial -- like to like transfers, water credits can be moved directly into a jurisdiction’s allocation for transfer to residential or other uses.
6. At a future PAC/TAC meeting a discussion of the water credit transfer rules should be part of the agenda.
B. Draft Ordinance No. 98 – An Ordinance of the Board of Directors of the Monterey Peninsula Water Management District Amending Residential Water Fixture Unit Values
On a motion by Choates and second by Morgan, the committees unanimously agreed that no connection fee should be charged for the addition of a second bathroom under this ordinance because no additional water demand will be associated with the bathroom. The fee should be set at $250 and assigned as follows: (A) $150 for processing the application, and (B) $100 for deposit into the District’s fund that pays for the toilet retrofit rebate program.
A motion was made by Koffman and seconded by Choates that on page 3 of the ordinance, paragraph 3, sentence 7, the words “(b) a single standard tub, or single shower stall, or a single standard tub-shower combination, and (c) a single wash basin” should be amended to state “ (b) a single standard tub and/or single shower stall, or a single standard tub-shower combination, and (c) a single or double wash basin.” The motion was approved unanimously.
A motion was made by Morgan and seconded by Hazdovac that any existing single family residential unit with one or two bathrooms that will be demolished can be rebuilt with at least two bathrooms. The motion was unanimously approved.
There was consensus among the committee members to refer to District Council the question of whether or not further CEQA review would be needed in order to expand this ordinance to include the addition of a second bathroom in new construction.
There was consensus among committee members that the ordinance should not be expanded to include multi-family dwellings.
A few members of the committees expressed interest in adopting Ordinance No. 98 as an urgency ordinance.
C. Draft Ordinance No. 100 – An Ordinance of the Board of Directors of the Monterey Peninsula Water Management District Temporarily Suspending Receipt of Applications for Water Credit Transfers
A motion was made by Morgan and seconded by Hazdovac that the committees not support the ordinance. The motion was approved unanimously. Choates was absent.
The following comments were expressed by the committees:
1. The intent of the ordinance is to prevent water from being transferred into a jurisdiction’s allocation so that it can be transferred to any use approved by the jurisdiction.
2. The jurisdictions should decide how water credits should be utilized.
Chairperson Potter requested that at the February 22, 2001 MPWMD Board meeting, the General Manager give an update on the status of the study that is underway to determine the water savings achieved when water credits are transferred from one property to another.
V. Adopt Meeting Schedule for Calendar Year 2001
The proposed meeting schedule was adopted.

Prior to adjournment, another joint PAC/TAC meeting was scheduled for March 1, 2001 at 10 AM in the District conference room. The meeting was adjourned at 11:40 PM.
