SUBJECT: Carmel River Advisory Committee Recommendation to Board of Directors Regarding Ordinance No. 96

At today's meeting of the Carmel River Advisory Committee (Committee), under Agenda Item IV (Review Draft Ordinance No. 96 - an Ordinance of the Board of Directors of the Monterey Peninsula Water Management District Revising the Definition of and Regulation of Water Distribution Systems), the Committee adopted the following motion by vote of five to two:

"The Carmel River Advisory Committee recommends to the Board of Directors against passage of Ordinance No. 96 because:

• lack of sensitivity to existing water users, especially agricultural users and existing property owners;
• lack of sensitivity to rights of owners of lots of record;
• no provision for replacement of existing wells;
• lack of a sunset clause;
• the basis for the ordinance needs to be more clearly defined, especially with regard to public sentiment;
• lack of clarity of standards and definitions;
• lack of identification of overall benefits as compared with overall impacts to property owners and the community."
