SUMMARY: The Board is considering the second reading and adoption of Ordinance No. 107 (Exhibit 13-A). Ordinance No. 107 rescinds Ordinance No. 102 and reinstates Rule 28, Water Use Credit Transfers.
RECOMMENDATION: District staff recommends that the Board
approve the second reading of Ordinance No. 107 and adopt the ordinance. If passed on second reading, the ordinance
will become effective 30 days later.
BACKGROUND: Ordinance No. 102 was adopted on February 28,
2002 following the reconsideration and subsequent revocation of Ordinance No.
101 in December 2001. The ordinance revoked District Rule 28-B,
Property-To-Property and Property-To-Jurisdiction Transfers of Water Use
Credits for Commercial and Industrial Uses and deleted reference to District
Rule 28-B in Rule 28-A.
Ordinance No. 101 modified the Water Use Credit transfer program by incorporating safeguards to prevent an increase of water use beyond the original projection at the receiving site, and included safeguards to ensure more reasonable estimates of water use capacity at the donor site. Ordinance No. 101 was reconsidered after adoption at the request of Director Henson.
IMPACT ON RESOURCES: Adoption of Ordinance No. 107 is expected to have minimal impacts on staff.
