SUMMARY: The Board is considering an application to transfer 0.560 acre-feet per year (afy) of Water Use Credits from a former restaurant in Carmel to the City of Carmel-by-the-Sea. This application has been scheduled for public hearing twice, in January 2003 and April 2003, and continued both times at the request of the applicant.

The staff report containing a full explanation of the Water Use Credit transfer application, recommendation, and background information from the April 21, 2003 Board meeting is attached as Exhibit 18-A.

RECOMMENDATION: District staff recommends approval of the transfer of 0.560 afy of water use credits to the City of Carmel-by-the-Sea. The application meets the specific requirements of District Rule 28-B to qualify for a property-to-jurisdiction transfer. If approved, the following documents will be recorded on the title of the originating property as a condition of the transfer:

1. Notice and Deed Restriction Regarding Limitation on Use of Water on a Property.

2. Notice and Deed Restriction to Provide Public Access to Water Use Data

3. Declaration Regarding Consideration Given for Transfer of Water Use Credits.
