SUMMARY: On December 4, 2003, Director Edwards requested a reconsideration of the November 24, 2003 unanimous action by the Board to adopt the second reading version of Ordinance No. 109. Attached as Exhibit 13.A-1 is the second reading version of Ordinance No. 109 that was considered by the Board on November 24. Attached as Exhibit 13.A-2 is a list of changes that were made to the Ordinance on November 24.

RECOMMENDATION: The Board should determine whether or not it wishes to reconsider adoption of Ordinance No. 109. According to District Meeting Rule No. 23, a motion to reconsider must be made by a Director who voted on the prevailing side of the previous vote in question.

BACKGROUND: At the November 24, 2003 Board meeting, the motion to adopt Ordinance No. 109 was approved unanimously by Directors Edwards, Erickson, Henson, Lehman, Lindstrom, Pendergrass and Potter. For additional information, please refer to minutes of the November 24 meeting provided under agenda item 1, Consider Approval of Minutes of the Regular Board Meeting of November 17, 2003 and the Special Board Meeting of November 24, 2003.
