SUMMARY:
At the August 21,
2006 Closed Session of the Board, the Directors adopted a Memorandum of
Understanding (MOU) with the Management
Staff Bargaining Unit for wages and benefits for the term of July 1, 2006
through June 30, 2007. A copy of the
adopted MOU has been on file at the District office, and available for public
inspection, since August 22, 2006.
District staff recently discovered that adoption of the MOU had
inadvertently not been listed on the August 21, 2006 Closed Session agenda. District staff contacted District Counsel
Laredo for advice on how to correct the noticing error. District Counsel determined that since the
MOU was approved at the closed session, and the action was subsequently
reported during the August 21 open session, the document is viable and does not
need to be adopted or signed a second time.
He advised that the Board correct for the agenda noticing error by
taking action to ratify the MOU under the Consent Calendar at the September 18,
2006 meeting.
RECOMMENDATION:
District staff recommends ratification of the Memorandum of
Understanding with the Management Staff Bargaining Unit that was adopted by the
Board at the August 21, 2006 Closed Session.
