Call to Order
The meeting was called to order at 8:50 AM in the conference room of the Monterey Peninsula Water Management District office.

Minutes of December 8, 2005 Committee Meeting
On a motion
by Director Markey and second by Director Knight, the minutes were received on
a vote of 2 – 0.
2.
Discuss
Conceptual Ordinance No. 124 (since renumbered 125) – Clarifying Rules Related
to Water Permits and Credits
On a motion by Director Markey and second by Director Foy, the committee recommended on a vote of 3 – 0 that the Board conduct conceptual review of the ordinance prior to the first reading, and that the Board be advised that the committee supports revising the water permit regulations to provide clear guidelines for the public and staff.
During the discussion of Conceptual Ordinance No. 124, the directors suggested that an outline be prepared for the Board that identifies language in the draft ordinance that was not part of the original water permit rules. The outline should also identify sections in the ordinance where Board decision-making authority would be transferred to the General Manager. The memo should specify wherever a practice has been revised or a new concept is presented, and this should also be noted in the Findings. New language should be italicized in the conceptual ordinance.

Review
Potential Change to District Rule 20.C Exempting that Portion of Former
On a motion
by Director Markey and second by Director Knight, the committee recommended on
a vote of 3 – 0 that a separate ordinance should be developed that addresses
this issue, and that a conceptual ordinance should be presented to the Board
prior to first reading.
During the committee
discussion, Ms. Pintar said that she would check with District Counsel Laredo
to determine if conceptual Ordinance No. 124 should state that no water permit
from the District is required for development in the exempt

Review 2005
District staff was requested to develop a response to the Monterey County Grand Jury advising them that: (1) the District appreciates the statement that Ordinance No. 98 “is a positive step forward;” (2) in the future, Grand Jury members should interview District staff and Board members to collect accurate information on our rules before making recommendations; and (3) the Grand Jury’s statement that a resident’s historical water use record “is available from public records” is incorrect, as that information is not a matter of public record.

The committee decided to meet again on March 21, 2006 at 3 PM.
