SUMMARY:  On March 22, 2008, the Board appointed Darby Fuerst to the position of Interim General Manager of the District and entered into an employment agreement commencing on March 22, 2008 and expiring on December 31, 2008.  As part of the agreement, the parties agreed to meet to discuss renewal of the agreement or execution of alternate terms of employment by November 1, 2008.  The parties have met and developed a new employment agreement that appoints Darby Fuerst to the position of General Manager of the District for the period from December 9, 2008 through December 31, 2009 (Exhibit 2-A). 

 

The new agreement is the same as the original agreement except that the position is no longer “interim” and the compensation has been increased.  Specifically, the salary has been increased by 2.1% to $149,000 per year and the automobile allowance has been increased from $300 to $400 per month.  In addition, the cap on the District’s matching payment into Mr. Fuerst’s deferred compensation program has been increased from 2% to 4% of Mr. Fuerst’s annual salary, subject to actual contributions to the deferred compensation plan.  Similar to the original agreement, the parties agree to meet to discuss renewal of the agreement or execution of alternate terms of employment no later than November 1, 2009.

 

RECOMMENDATION:  The Board should consider whether or not to appoint Darby Fuerst to the position of General Manager and approve the proposed agreement of employment for the period December 9, 2008 through December 31, 2009 (Exhibit 2-A).

 

IMPACT ON STAFF/RESOURCES:   The increase in salary and benefits between the Interim General Manager position and the General Manager position is $7,240.  This increase is within the Board-authorized General Manager’s office budget for Fiscal Year 2009.
