SUMMARY: Attached as Exhibit 2-A are Findings of
Denial for the appeal of the General Manager’s decision regarding the
non-compliance of California American Water’s Hidden Hills Water Distribution
System with the Pro Rata Expansion Capacity outlined in Rule 40-D. The hearing regarding these appeals was
conducted on May 21, 2009 and July 20, 2009.
In denying the appeal of the decision, the Board granted an exception to
the moratorium on new or expanded water use for those applications that can
demonstrate submittal to
RECOMMENDATION: If adopted with the Consent Calendar, the Findings of Denial attached as Exhibit 2-A shall be finalized.
