SUMMARY:  As a party in the California Public Utilities Commission (CPUC) proceeding for California American Water’s (Cal-Am) application for the Coastal Water Project (CWP), the District is participating in regard to the scope, governance, costs, and financing of the Regional Water Supply Project.  At the June 15, 2009 meeting, the Board authorized the General Manager to enter into a professional services agreement with David J. Stoldt, an expert in public and private project financing, to assist the District at a cost not to exceed $20,000.  At the March 25, 2010 meeting, the Board authorized an additional $10,000, for a total not-to-exceed amount of $30,000.  Through the end of May 2010, Mr. Stoldt provided services to the District totaling approximately $29,500.  As an expert witness for the District, Mr. Stoldt will continue to assist in ongoing discussions and travel to San Francisco for the formal hearing.  Mr. Stoldt’s services in June 2010 will not exceed $5,000.  If Mr. Stoldt’s services are needed in Fiscal Year 2010-2011, a new contract will be negotiated.

 

RECOMMENDATION:  Staff recommends that the Board authorize the General Manager to amend the existing professional services agreement with David J. Stoldt to continue his participation in the CPUC proceeding by adding $5,000 to the cost cap.

 

IMPACTS TO STAFF AND RESOURCES:  The 2009-2010 budget allocates $25,000 for “Coastal Water Project/Regional Project – Financial Consultant.”  Amending Mr. Stoldt’s contract as proposed will require $5,000 from the Capital Projects contingency fund.  District Counsel David Laredo is coordinating staff’s efforts in this proceeding, and District Engineer Andrew Bell is administering Mr. Stoldt’s contract.
