A Resolution of the Board of Directors of the

Monterey Peninsula Water Management District

ADOPTING Guidelines For and lifting the suspension of

THE Lawn Removal Rebate PROGRAM

WHEREAS District Rule 141 sets forth the provisions of the Water Conservation Rebate Program; and

WHEREAS, on January 27, 2011, pursuant to Resolution 2011-03, the Monterey Peninsula Water Management District (Water Management District or District) Board of Directors suspended the receipt and processing of Lawn Removal Rebate applications pending approval of program guidelines and additional funding for the Lawn Removal Rebate Program; and

WHEREAS on February 8, 2011, the California Public Utilities Commission authorized additional funding for the Rebate Program (including the Lawn Removal Rebate Program); and

WHEREAS, District staff has proposed guidelines for the Lawn Removal Rebate Program that require additional information from the applicant and clarify the qualifying criteria for the program. A copy of the proposed Guidelines is attached hereto as Attachment A; and

WHEREAS, the proposed Guidelines were reviewed and approved by the Water Demand Committee at its February 2011 meeting.

NOW, THEREFORE BE IT RESOLVED AND ORDERED THAT the Board of Directors of the Monterey Peninsula Water Management District hereby resolves that the Guidelines for Lawn Removal Rebates shown as Exhibit A shall be used henceforth to administer the Rebate for Lawn removal and replacement with low water use plants or permeable surfaces and for Synthetic Turf installation; and

BE IT FURTHER RESOLVED AND ORDERED THAT the Board of Directors of the Monterey Peninsula Water Management District resolves that the January 27, 2011, suspension on the receipt of applications for Rebates for Lawn removal shall be rescinded upon adoption of this Resolution.
