SUMMARY: Two previous items on the Consent Calendar request Board approval of negotiated Memorandums of Understanding (MOU’s) with the General Staff Bargaining Unit and the Management Staff Bargaining Unit. These MOU’s include agreements for employees to begin paying a portion of their salary towards both the Member and the Employer portions of the California Public Retirement System (CalPERS) contribution.
Currently, the District pays the entire 7% Member Contribution
to CalPERS and reports the value of the Member Contribution
as salary. CalPERS requires the
District to adopt a resolution for each change to the method in which we pay
and report the value of the Employer Paid Member Contribution. The changes,
effective in each of the three years covered by the MOU’s,
are addressed by Resolution 2013-X, attached as Exhibit 15-A, Resolution 2013-Y, attached as Exhibit 15-B and Resolution 2013 Z, attached
as Exhibit 15-C.
Currently, the District pays the entire 12.9% Employer Contribution to CalPERS. Resolution 2013-ZZ, attached as Exhibit 15-D, would allow employee payments towards the Employer Contribution to be made on a pre-tax basis, in accordance with Section 414 (h) (2) of the Internal Revenue Code.
RECOMMENDATION: Approve the Resolutions regarding Employee contributions to the California Public Employees Retirement System, if approval is granted to the negotiated MOU’s with the General Staff Bargaining Unit and Management Staff Bargaining Unit.
