SUMMARY: According to the Charge to the MPWMD Ad Hoc Legislative Advocacy Committee (Exhibit 5-A), the committee’s primary function is to provide a recommended policy position to the Board concerning the draft Cease and Desist Order (CDO) regarding continued unauthorized Carmel River diversions that was issued against California American Water on January 15, 2008 by the State Water Resources Control Board. The charge was adopted by the Board on February 28, 2008. Since that time, the Board has requested that the Committee coordinate with local and State regulatory agencies regarding the 95-10 Desalination Project, and implementation of regulations that would allow installation of greywater system. The charge appears to be focused on the CDO, however; item 4.c of the charge does state that the Committee is responsible to “undertake other tasks as designated by the Board Chairperson.”
RECOMMENDATION: The Committee should review the Charge to the MPWMD Ad Hoc Legislative Advocacy Committee (Exhibit 5-A) and determine if it is a comprehensive description of the duties the Committee has been requested to undertake, or if it should be expanded.
