SUMMARY: District Board Members have been compensated for meeting attendance at the rate of $100 per meeting, to a maximum of five meetings per month, since July 2004. Current law governing the amount Board Members can be paid allows the compensation to increased each calendar year by five percent. The law also allows Board Members to be compensated for up to ten days per month. Exhibit 5-A is a letter from the General Counsel David Laredo, dated June 28, 2006, regarding this subject. Exhibit 5-B is a draft of Ordinance No. 126, which would increase Board compensation from $100 to $110 per day, and also increase the maximum days eligible for compensation from five to ten days per month. Both changes would become effective on the 61st day after the Ordinance is enacted on second reading.
RECOMMENDATION: The Administrative Committee reviewed this item at its July 6, 2006 meeting and voted __ to __ to recommend ______________. The Board should accept public comment, and then consider approval of the first reading of Ordinance No. 126 – An Ordinance of the Board of Directors of the Monterey Peninsula Water Management District Setting Compensation for Board Members. If the first reading of the Ordinance is approved, the second reading should be scheduled for the August 21, 2006 Board meeting.
BACKGROUND: District Board Members are presently compensated for meeting attendance, pursuant to Water Code Sections 20200 through 20207 and District Ordinance No. 113, at the rate of $100 per meeting, up to a maximum of five meetings per month. This level of compensation took effect in July 2004. Water Code Section 20202 allows the District to set compensation of Board Members for each day’s attendance at meetings of the Board, or for each day’s service rendered as a member of the Board by request of the Board, not to exceed ten days per month. This section also authorizes the rate of compensation to be increased by up to five percent per calendar year since the operative date of the last compensation adjustment. An ordinance must be adopted by the District pursuant to the Water Code to invoke any compensation increases for Board Members. A potential increase to Board compensation was discussed at the May 25, 2006 Board budget workshop. At that time, staff was requested to increase the Board Compensation line item of the proposed 2006-07 budget for the estimated incremental cost to increase compensation by $10, to $110 per meeting; with the maximum number of meetings being increased from five to ten meetings per month. Staff was also directed to present a draft ordinance for first reading at the July 2006 Board meeting that would initiate the suggested changes.
