SUMMARY: In February 2005, the Board authorized Deed Restriction Implementation Guidelines (Exhibit 1-A) for use of the various deed restrictions used by the District. Currently, there are 42 deed restriction templates (Exhibit 1-B). The guidelines allow modifications to the deed restriction templates used by the District to be implemented immediately with authorization from the General Manager and District Counsel. Changes are then reviewed by the Rules and Regulations Committee. Deed restrictions are routinely used by the District for enforcement of rules and conditions and to notify current and future property owners of specific conditions, violations or restrictions on a property.
After adoption of Ordinance No. 141 in November 2009, a template was required for Lawn removal and installation of low water use plants (or permeable surfaces) or installation of synthetic turf. In keeping with the Deed Restriction Implementation Guidelines, staff is providing a copy of this form to the Rules and Regulations Committee for review.
RECOMMENDATION: Staff recommends that the Committee approve the Deed Restriction Template attached as Exhibit 1-C.
