SUMMARY: In February 2009, the Water Demand Committee reviewed an outline of revisions to MPWMD Regulation XIV, Water Conservation. Staff has completed a preliminary draft ordinance (Exhibit 2-A) for discussion and a recommendation by the Water Demand Committee. The ordinance will be considered on April 7, 2009 by the Technical Advisory Committee, prior to first reading by the Board at the April 20, 2009 regular meeting.
Revisions to Regulation XIV began in 2008 after Director Brower requested consideration of a mandate for installation of Zero Water Consumption Urinals for new Non-Residential New Construction and Remodels. At that time, staff indicated a need to update the conservation regulation. The current regulation is out of date and requires clarifications and amendments similar to those done to the Permit Regulation (Regulation II) in 2006. A follow-up ordinance will address baseline outdoor water use guidelines and restrictions.
DISCUSSION: Staff has continued to refine the proposed amendments based on comments received at the February 2009 Water Demand Committee meeting and discussions with landscape irrigation experts and others. Staff met with a representative of the hospitality industry (Bob McKenzie) on March 18, 2009. Mr. McKenzie was given a copy of the updated outline for review, and staff will follow up with him in the next week. A copy of this staff report and the preliminary draft ordinance will be forwarded to the parties that have participated in this effort. The revised outline, showing existing and proposed requirements, is attached as Exhibit 2-B.
RECOMMENDATION:
Staff recommends the Water Demand Committee review the draft ordinance
and provide feedback to staff before recommending adoption by the Board.
