SUMMARY: Resolution 2008-01 (Exhibit 7-A) Rule 24-B, amends Table 2: Non-Residential Water Use Factors to note that unenclosed structures (i.e. areas not totally surrounded with a combination of walls, windows, doors, floor and roof, such as; carports, garages with no doors, porches, decks, patios, rooftops and balconies) are exempt from the Non-Residential Permit requirements and have no Water Credit value. District Rule 11, Intensified Water Use, states “Where there is no increase in the size of a commercial structure, a change in use from one commercial category in Group I to another category within Group I shall not cause an intensification of water use.” Water Permits are not required for installation of unenclosed structures, and no Water Credits are available.
District Rule 24-B Non-Residential Calculation of Water Use
Capacity (Exhibit 7-B) allows changes to Table 2:
Non-Residential Water Use Factors (Exhibit 7-C) by Board Resolution. Adding
a footnote to Table 2 that explains the exception for unenclosed structures
will clarify the table and reduce the number of unnecessary Water Permit
applications. District staff
supports an amendment to the table to ensure consistency in the rule
application.
RECOMMENDATION: The Technical Advisory Committee should review and discuss the proposed change to Table 2: Non-Residential Water Use Factors and provide feedback to staff.
